New Overtime Notice Requirement Takes Effect in Connecticut This October

Connecticut employers with 100 or more employees have a new compliance requirement to prepare for before October 1, 2026.

Under a new state law, covered employers must create and maintain a guide explaining the overtime pay codes and pay differentials used within their organization. The guide must also be made available to employees in specific ways.

Who's Covered?

The new requirement applies only to employers with 100 or more employees.

If your business falls below that threshold, this new notice requirement doesn't apply, although Connecticut's existing overtime and wage statement rules remain in effect.

What Does the New Law Require?

Beginning October 1, covered employers must create a guide explaining the overtime-related pay codes employees may see on their paychecks.

Depending on your organization, this may include:

- Shift differentials
- Holiday pay
- On-call pay
- Call-back pay
- Weekend pay
- Hazard pay
- Geographic pay differentials

The guide must also include contact information for the person or department employees should contact with questions about hours worked or pay differences.

How Must Employees Receive It?

The guide must be:

- Posted on your company website in English, Spanish, and any other commonly spoken employee language
- Shared with new hires (or provided in writing if no website exists)
- Referenced on employee hour records
- Updated whenever new pay codes or pay differentials are introduced

Employers are not required to create a website solely for this purpose, and they don't need to create new pay codes if they don't already use them.

What Should Employers Do Now?

Before October 1:

- Confirm whether your organization meets the 100-employee threshold.
- Review the overtime pay codes and pay differentials you currently use.
- Create and publish your pay code guide.
- Designate a contact for employee questions and include that information in the guide.
